ACFE Response
to press release by Secretary of State
Thank you for
your recent response to our letter of November 20
expressing concern about the testing and
certification of election equipment in Arizona. We
appreciate your attention to this matter. There
are a few points in your letter, however, that
necessitate clarification.
First, you state that Federal Law (HAVA) mandates
the use of touch-screen voting systems by the 2006
federal election. This is not accurate. The
HAVA law requires the use of "direct
electronic voting system or other voting
system equipped for individuals with

Letter from Secretary of State in Response to ACFE
Dear Mr. Ryan,
Pursuant to
Arizona Revised Statutes Title 16, Article 4 all
voting systems must meet mandatory requirements in
order to be used in the conduct of an election in
the state of Arizona. Specifically, A.R.S. 16-441
and 16-442 mandate that all voting systems used
for Arizona elections must be officially certified
by the Secretary of State. Let me point out
that I authored the legislation this past year
which requires -- for the first time ever in the
Arizona Revised Statutes -- voting equipment
receive the full testing and certification by a
laboratory that is accredited pursuant to the Help
America Vote Act of 2002. These statutes require
official certification prior to the use of any
voting system for an Arizona election.

– Secretary of State Jan Brewer announced today
she will lead a new effort to formulate a voting
system action plan that will address statewide
voting systems and technology. The plan specifically calls for new voting system guidelines,
increased sharing of information among election
offices, and annual reviews to enhance election

has become evident that recent election
proceedings in Tucson and Pima County have
violated state law. The 2002 Pima County and 2003 City of Tucson primary and
general elections were conducted on election
equipment running uncertified software and
